Terms of Service for Themys

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Themys website and application (the "Service") operated by Themys.
1. Acceptance of Terms
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2. Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
3. Lifetime Deal (Beta Founders) Rules
Our Lifetime Deal is an exclusive reward for those who actively help us build Themys. To prevent abuse, the following binding conditions apply to receive this deal:
3.1. Quality over Quantity
Simply creating an account or passively sitting on our Discord is not enough. We consider activity to be reporting real bugs, providing meaningful feature suggestions, and actively participating in testing. Spamming short or meaningless messages (just to "show activity") will be ignored.
3.2. Exclusive Right to Grant
Receiving the Lifetime Deal is not automatic. We reserve the full and exclusive right to individually evaluate the contribution of each member and, at our sole discretion, decide who will receive this bonus upon the official launch of the app.
3.3. Strictly Non-Transferable (No Selling)
The Lifetime Deal is tied exclusively to you (your specific Discord account and the email registered in the app). It is strictly prohibited to sell, gift, or otherwise transfer the account to anyone else. Any attempt to sell the account will result in its immediate and permanent cancellation without compensation.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Themys and its licensors. The Service is protected by copyright, trademark, and other laws of both Slovakia and foreign countries.
5. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
6. Limitation of Liability
In no event shall Themys, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.
7. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
